FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 12, 2019

TO:
Honorable Jeff Leach, Chair, House Committee on Judiciary & Civil Jurisprudence

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB2547 by Meyer (Relating to the assignment of certain former and retired justices and judges.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to allow the chief justice of the Texas Supreme Court to assign former justices or judges for active service in a court. The minimum experience required for a judge or justice to qualify for assignment would be reduced from 96 months to 72 months, and an assigned judge or justice would be required to refrain from practicing law for a period of two years after certification, but only before the court to which the judge or justice was assigned. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
