No significant fiscal implication to the State is anticipated.

The bill would amend the Chapter 502 of the Transportation Code to require an application for vehicle registration to provide space for the applicant to voluntarily list any health condition that may impede communication with a peace officer as evidenced by a licensed physician or licensed psychologist as applicable to the health condition. The bill would require the Department of Motor Vehicles (DMV) to provide to the Department of Public Safety (DPS) the vehicle registration information of a person who lists a health condition on the registration application. The bill would require DPS to include this information in the Texas Law Enforcement Telecommunications System for the purpose of alerting a peace officer who makes a traffic stop that the operator of the stopped vehicle may have a health condition that may impede communication.

Based on the analysis provided by DMV, it is assumed the agency would incur one-time information technology programming costs to update registration and titling systems and applications to capture the additional registration applicant information required by the bill. Based on LBB staff analysis of the information provided by DMV, it is assumed these costs would be absorbed within the agency's current funding to implement the provisions of the bill by the effective date of September 1, 2019.

Based on the information provided by DPS, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
