No significant fiscal implication to the State is anticipated.
The bill would amend the Utilities Code to allow a person to file a civil action against an excavator who fails to provide notice of excavation within a designated time frame or contact the underground facility operator of any damage caused by the excavation.
Based on the analysis of the Public Utility Commission of Texas and the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
