No significant fiscal implication to the State is anticipated.

The bill would amend the Transportation Code to specify that a contractor who enters into a contract with certain governmental entities for construction or repair of a road or highway is not civilly liable or responsible for project specifications and any damage caused by a defect in project specifications or certain faults of the governmental entity related to the project specifications. The bill would define "governmental entity" as the Texas Department of Transportation (TxDOT) or any political subdivision of the state acting under Transportation Code Chapters 284 (certain counties), 366 (regional tollway authority), 370 (regional mobility authority), or 431 (transportation corporation).
 
Based on the information provided by TxDOT, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed with in the agency's existing resources.
