No significant fiscal implication to the State is anticipated.
The bill would amend the Civil Practice and Remedies Code to make the award of court costs and attorney's fees to the prevailing party in a motion after dismissing a claim for lack of basis in law or fact discretionary rather than mandatory.
Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect September 1, 2019.
