No significant fiscal implication to the State is anticipated.

The bill would amend Subchapter K, Chapter 623 of the Transportation Code, to authorize the issuance of permits for the movement of oversize and overweight vehicles by a port authority that meets certain geographic and population characteristics on certain routes to be designated by the Texas Transportation Commission that connect to the entrance of the Port of Palacios. The bill would take effect immediately if it receives a vote of two-thirds of all members elected to each house or, otherwise, on September 1, 2019.

Based on the analysis provided by the Texas Department of Transportation (TxDOT), it is assumed the bill would authorize the Port of Palacios to issue permits for the movement of oversize/overweight vehicles on the designated routes. As authorized by Transportation Code §623.214, it is assumed the port authority would assess and collect a permit fee in an amount not to exceed $120 per trip, of which an amount not to exceed 15 percent may be retained by the county for administrative costs and the remaining amount is require to be deposited to the State Highway Fund. Based on the information provided by TxDOT, it is assumed any permit fee revenue deposited to the State Highway Fund would be used to cover the costs of maintaining roadways on the designated routes.

Local Government Impact

It is assumed implementation of the bill would result in a positive impact to the Port of Palacios in Matagorda County.
