No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure by relocating a provision related to the discovery by a prosecutor of any exculpatory, impeachment, or mitigating evidence. Based on the analysis of the OCA, the relocation would not modify existing law and the duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
The bill would take effect immediately upon receiving a two-thirds majority vote in each house. Otherwise, it would take effect September 1, 2019.
