HB3792 by Goldman (Relating to clerks of justice courts and deputy constables.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code to provide that a clerk of the justice court serve at the pleasure of the justice of the peace. The bill would also amend the Local Government Code to provide that a designated chief deputy constable serve at the pleasure of the elected constable and that a chief deputy constable and a clerk of the justice of the peace are exempt from the county civil service system.
 
Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
 
The bill would take effect immediately if it receives a vote of two-thirds of all the members elected to each house, or September 1, 2019.

Local Government Impact

According to the Texas Association of Counties, no significant fiscal implication to units of local government is anticipated.
