HB3848 by Longoria (Relating to adoption of the Electronic Wills Act.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Estate Code to create the Electronic Wills Act. It would create procedures for a person to sign a will that exists as an electronic document. Affidavits of witnesses to a testator's signature could also be signed in an electronic form. The bill would allow for electronic notarization of wills and would specify requirements to make electronic wills self-proving. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
