IN RE:
HB3918 by Dutton (Relating to suits against certain governmental employees.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Civil Practices and Remedies Code to provide that filing a lawsuit against a governmental unit does not restrict the plaintiff from bringing a suit against an employee of the governmental unit for assault, battery, false imprisonment, or any other intentional torts, including a tort involving disciplinary action by school authorities.

Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.

The bill would take effect September 1, 2019.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
