The bill would amend the Code of Criminal Procedure regarding sentencing proceedings in capital cases to add that evidence of the views of a close relative of a deceased victim regarding the imposition of the death penalty in the case may be presented during a sentencing proceeding. The bill would require that a jury be instructed to consider all evidence, including the views of a close relative of a deceased victim regarding the imposition of the death penalty in the case. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
