LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 16, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB4041 by Toth (Relating to prohibiting the enforcement of certain federal laws; creating a criminal offense.), As Introduced

No significant fiscal implication to the State is anticipated.

Based on analysis by the Office of Court Administration, the provisions of the bill relating to firearm laws can be implemented within existing resources. Based on analysis by the Office of the Attorney General, while the enforcement provisions of the bill would require additional staff resources to field increased complaints, this can be accomplished within existing state resources.

Local Government Impact

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in jail for a term not to exceed one year, or both. Costs associated with enforcement, prosecution and confinement could likely be absorbed within existing resources. Revenue gain from fines imposed and collected is not anticipated to have a significant fiscal implication.
