No significant fiscal implication to the State is anticipated.
The bill would amend the Finance Code to prohibit a court from awarding attorneys fees to a financial institution even if the financial institution timely files an answer in a writ of garnishment case unless the garnishor unsuccessfully contests the answer. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished using existing resources.
