No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code to authorize an action against a county to require the redaction of an unconstitutional restriction from an instrument conveying an interest in real property.

According to the Office of Court Administration (OCA), no significant impact to the state court system is anticipated.

Local Government Impact

According to OCA, although the bill would allow a person to bring an action against a county for the redaction of certain language in an instrument, any case volume driven by the bill could be absorbed by existing resources and no significant fiscal impact to local courts is anticipated.

According to the Texas Association of Counties, the bill would likely have a significant fiscal impact on counties. However, the amount of that impact cannot be determined at this time.
