LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 17, 2019

TO:
Honorable Harold V. Dutton, Jr., Chair, House Committee on Juvenile Justice & Family Issues

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB4612 by Shaheen (Relating to the collecting of wages for child support payments.), As Introduced

The fiscal implications of the bill cannot be determined at this time.

The bill amends the Family Code to adjust the types of employers subject to child support collection requirements. The bill takes effect immediately if it receives at least a two-thirds vote in both houses of the legislature, else on September 1, 2019.

Based on analysis by the Comptroller of Public Accounts, the bill would make additional entities subject to civil penalties and fines. However, because the extent of these penalties cannot be reasonably estimated the overall revenue implications of the bill cannot be determined at this time.

Based on analysis by the Office of the Attorney General, it is assumed that the provisions of the bill relating to child support collections could be absorbed using existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
