No significant fiscal implication to the State is anticipated.

The bill would amend Section 162.007(a) of the Family Code related to the Health, Social, Educational, and Genetic History (HSEGH) report to include information related to alcohol and controlled substance abuse. The bill would amend subchapter A of the Family Code to add section 264.019 to require the Department of Family and Protective Services (DFPS) to collect and track data in the Information Management Protective Adults and Children in Texas (IMPACT) system related to children affected by alcohol and controlled substance abuse. DFPS would adopt any rules to implement the provisions of the bill and would be required to implement the provisions of the bill only if the commissioner determined that sufficient funds were appropriated to make the necessary upgrades to IMPACT. If DFPS determines that funds are not sufficient, upgrades would be implemented no later than the date of DFPS's next update to IMPACT.

The bill would amend subchapter B, Chapter 531 of the Government Code to add section 531.02143 which would require the Health and Human Services Commission (HHSC) to collect and report data to DFPS for Medicaid recipients regarding newborn children treated for exposure to alcohol or a controlled substance.
 
DFPS would be required to submit a report by November 1, of each even numbered fiscal year for the preceding fiscal year containing information required by section 264.019 of Family Code and section 531.02143 of the Government Code, as well as post to the report on DFPS's website and electronically submit the report to the legislature.

The bill would take effect January 1, 2020.

Based on the LBB's analysis of DFPS and HHSC, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
