Fiscal Analysis

The bill would prohibit a school district from offering human sexuality instruction unless the Commissioner of Education determines that the district's planned instruction and curriculum complies with existing statutory requirements related to human sexuality instruction. The agency would have to  provide school districts with a determination no later than 30 days before the first day of school and provide school districts with the opportunity to revise noncompliant curriculum or materials. These provisions would apply beginning with the 2020-2021 school year.

The bill would add to the notice school districts are required to provide parents regarding human sexuality instruction information on each date that instruction would be provided and the content provided on each date. The bill would also add a requirement that school districts provide by mail or e-mail all human sexuality curriculum materials to parents. These provisions would apply beginning with the 2019-2020 school year.

The bill would take immediate effect if it receives a two-thirds vote of each house of the Legislature. Otherwise, the bill would take effect September 1, 2019.

Methodology

According to the Texas Education Agency (TEA), 2.0 FTEs would be required to review each school district's human sexuality curriculum and materials to determine compliance with Texas law. Costs associated with these FTEs would total $351,348 in the 2020-2021 biennium.

Technology

According to TEA, the agency would need to develop an electronic system by which each district could submit its materials and supporting documentation to the agency. The agency estimates that the cost of this work would be $500,000 in fiscal year 2020.

Local Government Impact

Local school districts would be likely to face increased costs related to mailing or emailing all human sexuality curriculum to parents.
