SB1024 by Perry (Relating to access to services in an area annexed by a tier 1 municipality under a service plan.), As Introduced

No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to require a municipality to provide service in an annexed area under a service plan that is identical or substantially similar to access to those services in the municipality.  The bill would authorize a person in an annexed area to apply for a writ of mandamus for failure to provide this access.  Should an individual prevail in an action for the writ the bill provides for relief including payment of attorneys fees and court costs.  The bill would also abolish governmental immunity for municipalities in cases covered by provisions of the bill.

Local Government Impact

According to the Texas Municipal League, the cost of this bill to cities cannot be determined but could be substantial.
