No significant fiscal implication to the State is anticipated.
The bill would amend the Code of Criminal Procedure to require a court to order that any item with a counterfeit mark be destroyed or forfeited to the protected mark's owner if the return was requested by the protected mark's owner following the conviction or placement on deferred adjudication community supervision of a person for the offense of trademark counterfeiting. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
