No significant fiscal implication to the State is anticipated.
Based on analysis by the Secretary of State and the Office of Court Administration, it is assumed that the provisions of the bill relating to election petitions and ballot propositions could be absorbed using existing resources.
Local Government Impact
The bill provides that a city pay fair market value of all legal services regarding ballot proposition language enforcement and it waives governmental immunity allowing court costs, attorney fees and expenses. According to the Texas Municipal League, the fiscal impact cannot be determined because it is unknown how frequent the actions addressed in the bill would occur.
