April 30, 2019

TO:
Honorable John Whitmire, Chair, Senate Committee on Criminal Justice

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
SB1269 by Watson (Relating to extending the length of time for which an affidavit establishing probable cause for a search warrant may be sealed.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Code of Criminal Procedure to broaden the circumstances for which a felony prosecutor can request that a district judge or appellate court justice seal an affidavit relating to the establishment of probable cause for a search warrant and would allow a prosecutor to request a 30-day extension of the order under circumstances defined in the bill. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No significant fiscal implication to units of local government is anticipated.
