The bill would amend the Local Government Code to authorize certain counties to adopt regulations for lots in platted subdivisions that have remained undeveloped for 25 years or more.
Local Government Impact
According to the County of El Paso, there is an existing $173.9 million liability for future infrastructure improvements due to fractionalized ownership in the areas referenced by the bill. As development occurs within these platted subdivisions, residents will request access to basic services, including paved roadways and streetlights. Based on the amount of existing roadways recorded in platting documents with the County, there are 1,630 miles of roadway that would potentially require pavement. If passed, the bill would remove this liabliity from the County and return the cost of development to the private property owners engaging in home building activities in this area.
