No fiscal implication to the State is anticipated.

The bill would amend the Local Government Code to modify the process and procedures by which a municipality or county may apportion infrastructure costs as a condition of approval for a development project.

Local Government Impact

According to the Texas Municipal League, the bill provides that regulations in an extraterritorial jurisdiction are subject to the legal test of rough proportionality. The bill could result in additional costs incurred as a result of litigation, but the exact amount cannot be determined.

According to the Texas Association of Counties, the bill could result in additional costs to counties incurred as a result of litigation, but the exact amount cannot be determined.
