The bill would amend the Local Government Code and the Utilities Code to modify the process and procedures by which a municipality, county, or electrical cooperative may apportion infrastructure costs as a condition of approval for a development project.
Local Government Impact
According to the Texas Municipal League, the bill provides that regulations in an extraterritorial jurisdiction are subject to the legal test of rough proportionality. The costs from the bill cannot be determined, but the bill could result in additional costs incurred as a result of litigation.
