No significant fiscal implication to the State is anticipated.
The bill would amend the Penal Code as it relates to the offense of taking or attempting to take a weapon from certain officers, investigators, employees, or officials. Under the provisions of the bill, a prosecutor would no longer have to prove the actor took or attempted to take a weapon from certain persons with the intention of harming them. This offense is punished as a third degree or a state jail felony, depending upon the circumstances of the offense.
The Office of Court Administration and the Texas Department of Criminal Justice indicate the modifications outlined in the bill's provisions would not result in a significant fiscal impact. This analysis assumes the provisions of the bill addressing felony sanctions for criminal offenses would not result in a significant impact on state correctional populations or the demand for state correctional resources.
