No significant fiscal implication to the State is anticipated.

The bill would amend the Business and Commerce Code to add Chapter 94 regarding excess wear and use waivers for leases of motor vehicles. The bill would establish a civil penalty for a lessor that violates Chapter 94. The bill would allow an injured party to seek injunctive relief against a person committing the violation. The bill would authorize the Attorney General or a county or district attorney to bring an action in the name of the State seeking the civil penalty, injunctive relief, or both.

Based on the information provided by the Office of the Attorney General, it is assumed any costs or duties associated with implementing the provisions of the bill could be absorbed within the agency's existing resources. Based on information provided by the Office of Court Administration, it is assumed the bill would not result in a significant impact to the state court system.

Local Government Impact

According to the Texas Association of Counties, no significant fiscal implication to units of local government is anticipated.
