No significant fiscal implication to the State is anticipated.

The bill amends the Water Code to change the standard of review from a substantial evidence standard to a trial de novo with regard to appeals of final groundwater conservation district orders issued pursuant to a requested hearing appealing the reasonableness of the desired future condition of groundwater resources. The bill would also change the standard of review on appeal from substantial evidence to trial de novo with respect to judicial review for suits against groundwater districts. Based on the analysis of the Office of Court Administration, duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.
