SB2128 by Creighton (relating to the recording by a county clerk of certain documents concerning real or personal property.), Committee Report 1st House, Substituted

No significant fiscal implication to the State is anticipated.

The bill would amend the Property Code to add a provision that allows paper documents that are tangible copies of an electronic record certified by a notary public or other officer who may take an acknowledgment or proof of a written instrument to be recorded or to serve as notice of the paper document. The bill would also require the county clerk's index entry for a paper document recorded under the new provision to contain the names of the grantors and grantees. Further, the bill would provide the required form for declaration of the authenticity of an electronic record.
