LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 86TH LEGISLATIVE REGULAR SESSION

April 22, 2019

TO:
Honorable Lois W. Kolkhorst, Chair, Senate Committee on Health & Human Services

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
SB2351 by Hall (Relating to discrimination by a health care provider based on immunization status.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Government Code relating to discrimination by a health care provider based on immunization status.

The Health and Human Services Commission (HHSC) indicates there could be costs associated with establishing a process to receive complaints and terminate or suspend providers in Medicaid or the Children's Health Insurance Program who refuse to provide health care services to patients who are not vaccinated. The agency indicates this could vary depending on the number of providers impacted. This analysis assumes that HHSC could implement the provisions of the bill using existing resources.

The Texas Medical Board, Board of Dental Examiners, Texas Board of Nursing, Board of Pharmacy, and Department of State Health Services indicate that the duties and responsibilities associated with implementing the provisions of the bill could be accomplished by utilizing existing resources.

Local Government Impact

No fiscal implication to units of local government is anticipated.
