CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

May 5, 2019

TO:
Honorable Nicole Collier, Chair, House Committee on Criminal Jurisprudence

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB95 by Hinojosa (Relating to the criminal offense of acquisition or attempted acquisition of a firearm by a person prohibited from possessing a firearm.), As Introduced

The provisions of the bill addressed by this analysis would amend various codes as they relate to the unlawful transfer of certain weapons. Under the provisions of the bill, the knowing acquisition or attempted acquisition of a firearm by a person who is prohibited by state or by certain federal laws from possessing a firearm would be punishable as a Class A misdemeanor.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year and, in addition to confinement, an optional fine not to exceed $4,000. This analysis assumes the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
