CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 16, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB244 by Farrar (Relating to the prohibition of certain discrimination based on sexual orientation or gender identity or expression; providing an administrative penalty; creating a criminal offense.), As Introduced

The provisions of the bill addressed by this analysis would amend the Property Code as it relates to the offense of intimidating or interfering with a person in certain activities relating to the business of selling or renting a dwelling.  Under the provisions of the bill, intimidating or interfering with a person in these activities because of the person's sexual orientation or gender identity or expression would be punishable as a Class A misdemeanor.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year and an optional fine not to exceed $4,000.  This analysis assumes the provisions of the bill addressing sanctions for a criminal offense would not result in a significant impact on state correctional populations or the demand for state correctional resources.
