The provisions of the bill addressed by this analysis would amend the Code of Criminal Procedure as it relates to a defendant's waiver of a jury trial following a plea of guilty or nolo contendere for a felony offense. Under the provisions of the bill, a defendant may waive the right to a jury trial in the punishment phase without the consent of the attorney representing the state or approval of the court.
This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources. The bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.
