CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 7, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB784 by Davis, Sarah (Relating to conflicts of interest of members of state agency governing boards and governing officers; creating a criminal offense.), As Introduced

The provisions of the bill addressed by this analysis would amend the Government Code as it relates to open government and ethics in order to address conflicts of interest of state agency governing board members or officers.  Under the provisions of the bill, certain individuals who knowingly fail to comply with certain duties to disclose and refrain from participating in certain matters commit a Class B misdemeanor.

A Class B misdemeanor is punishable by confinement in county jail for a term not to exceed 180 days and in addition to confinement, an optional fine not to exceed $2,000. This analysis assumes the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
