TO:

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB900 by Israel (Relating to the act of smoking tobacco in a vehicle with a child present; authorizing an additional fine for certain criminal offenses.), Committee Report 1st House, Substituted

The provisions of the bill addressing criminal penalties are the subject of this analysis. The bill would amend the Transportation Code as it relates to smoking tobacco in a vehicle with a child present. Under the provisions of the bill, those who enter a plea of guilty or nolo contendere or who are convicted would pay a $15 fine or complete a parenting class.

This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources.
