The bill would amend the Government Code as it relates to the eligibility for early release from parole supervision for certain offenders. In addition to meeting other conditions, under current law a person must have been on parole at least one half of the time that remained on their sentence when they were released from prison onto parole in order to be eligible for early release from parole. Under the provisions of the bill, in addition to meeting other conditions, a person would be eligible for early release from parole if they had served ten years on parole or at least one half of the time that remained on their sentence when they were released from prison on to parole, whichever is less. The bill would apply to persons on parole or mandatory supervision on or after September 1, 2019.
Increasing the number of individuals eligible for early release from parole is expected to result in fewer demands on the State due to shorter terms under parole supervision. As of August 31, 2018, an additional 2,586 persons on parole would have been eligible for early release from parole if the bill's provisions had been in effect. Based on parole approval trends in the, this analysis assumes the number of persons granted early release would not result in a significant reduction in parole supervision populations or the demand for state correctional resources.
