CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 8, 2019

TO:
Honorable Eddie Lucio III, Chair, House Committee on Insurance

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB2102 by Capriglione (Relating to the payment of insurance deductibles related to property insurance policies; creating criminal offenses.), As Introduced

The provisions of the bill addressed by this analysis would amend various codes as they relate to the payment of insurance deductibles related to property insurance policies.  Under the provisions of the bill, engaging in certain behaviors in violation of the Insurance Code would be punishable as a Class A misdemeanor. The bill would also repeal the offense of certain insurance claims for excessive charges punishable as a Class A misdemeanor under existing statute.

A Class A misdemeanor is punishable by a fine of not more than $4,000, confinement in a county jail for a term not to exceed one year, or both. This analysis assumes the provisions of the bill addressing sanctions for criminal offenses would not result in a significant impact on the demand for state correctional resources.
