CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

TO:

FROM:

Legislative Budget Board

IN RE:
HB2434 by Schaefer (Relating to information regarding perinatal palliative care and prohibiting discriminatory abortions; creating an administrative penalty, a civil remedy, and a criminal offense.), As Introduced

The provisions of the bill addressed by this analysis would amend various codes as they relate to prohibiting discriminatory abortions. Under the provisions of the bill, certain persons would commit an offense if the person knowingly performed or attempted an abortion based on the race, sex, ethnicity, or disability of a woman's preborn child or if a person threatened or used force to coerce such an abortion. The offense would be punishable as a Class A misdemeanor.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year and, in addition to confinement, an optional fine not to exceed $4,000.

This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources.
