CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 18, 2019

TO:
Honorable James White, Chair, House Committee on Corrections

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB3015 by Talarico (relating to educational programs provided by the Windham School District in the Texas Department of Criminal Justice for certain inmates.), Committee Report 1st House, Substituted

The provisions of the bill that would amend the Education Code as it relates to educational programs for certain inmates are the subject of this analysis. Under the provisions of the bill, the Windham School District would be required to provide an educational program to those individuals outlined in the bill unless providing the program posed a significant safety threat to instructors.

This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources. The bill does not expressly create a felony offense, increase the punishment for an existing misdemeanor to that of a felony, increase the punishment for an existing felony offense or category of felony level offenses, or change the eligibility of a person for felony community supervision, parole, or mandatory supervision.
