The provisions of the bill addressed by this analysis would amend the Government Code as it relates to the criminal offense of conspiracy to circumvent the open meetings law. Under the provisions of the bill, a member of a governmental body commits an offense if the member knowingly engages certain activities outside of an open meeting concerning public business among less than a quorum of members.
 
The offense is punishable as a misdemeanor with a fine of not less than $100 or more than $500, confinement in the county jail for not less than one month or more than six months, or both. This analysis assumes the provisions of the bill would not result in a significant impact on the demand for state correctional resources.
