HB3938 by Moody (Relating to the consideration of the views of a close relative of a deceased victim regarding the imposition of the death penalty in a capital case.), As Introduced

The provisions of the bill addressing felony sanctions are the subject of this analysis. The bill would amend the Code of Criminal Procedure to add evidence of the views of a close relative of a deceased victim to sentencing proceedings involving the imposition of the death penalty in capital cases.  A capital felony is punishable by death, life in prison, or life in prison without parole.

In fiscal year 2018, 292 people were arrested and 80 people were admitted into state correctional institutions for capital offenses.  This analysis assumes the provisions of the bill addressing felony sanctions would not result in a significant impact on state correctional populations or the demand for state correctional resources.
