The provisions of the bill that would amend the Code of Criminal Procedure as it relates to a defendant making a donation in lieu of working a community service project are the subject of this analysis. Under the provisions of the bill, a judge can order a defendant to donate to a nonprofit, tax-exempt organization that supports drug courts serving the community in which the defendant resides instead of working at a community service project.
This analysis assumes the provisions of the bill would not result in a significant impact on state correctional populations or on the demand for state correctional resources. The bill does not expressly create a criminal offense, increase the punishment for an existing criminal offense or category of offenses, or change the eligibility of a person for community supervision, parole, or mandatory supervision.
