CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 7, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB4084 by Walle (Relating to the operation of unmanned aircraft over certain facilities; creating a criminal offense.), As Introduced

The bill would amend the Government Code as it relates to the operation of unmanned aircraft over certain facilities. Under the provisions of the bill, a person would commit an offense if the person intentionally or knowingly operates an unmanned aircraft near a school as specified in the bill. This offense would be a Class B misdemeanor and can be enhanced to a Class A misdemeanor depending on previous convictions.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year and, in addition to confinement, an optional fine not to exceed $4,000. This analysis assumes the provisions of the bill addressing sanctions for criminal offenses would not result in a significant impact on the demand for state correctional resources.
