The provisions of the bill addressing felony sanctions are the subject of this analysis. The bill would amend the Code of Criminal Procedure as it relates to the punishment for certain prostitution offenses. Under the provisions of the bill, a person convicted of a state jail felony and previously convicted three or more times of a prostitution offense would be placed on community supervision and, as a condition of community supervision, would participate in a rehabilitation program for certain prostitution offenses while confined. 

A state jail felony is punishable by confinement in a state jail for a term from 180 days to 2 years and, in addition to confinement, an optional fine not to exceed $10,000 or a Class A misdemeanor punishment. 


Modifying the punishment for prostitution and requiring confinement as a condition of community supervision according to the bill's provisions is expected to result in additional demands on the correctional resources of the counties or of the State due to an increase in individuals placed under supervision in the community and confined in state correctional institutions. In fiscal year 2018, for prostitution offenses as specified in the bill, 379 people were arrested, 111 were placed on felony direct community supervision, and 108 were admitted to a state jail facility. This analysis assumes the provisions of the bill addressing felony sanctions would not result in a significant impact on state correctional populations or on the demand for state correctional resources.
