CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 7, 2019

TO:
Honorable Dade Phelan, Chair, House Committee on State Affairs

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
HB4322 by Davis, Yvonne (Relating to prohibited employment of certain former commissioners of insurance and employees of the Texas Department of Insurance; creating an offense.), As Introduced

The bill would amend the Insurance Code as it relates to employment by certain former commissioners of insurance and employees of the Texas Department of Insurance. Under the provisions of the bill, a former commissioner or an employee would commit an offense if employed by certain entities within the time period specified in the bill. This offense would be a Class A misdemeanor.

A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year and, in addition to confinement, an optional fine not to exceed $4,000. This analysis assumes the provisions of the bill addressing sanctions for criminal offenses would not result in a significant impact on the demand for state correctional resources.
