CRIMINAL JUSTICE IMPACT STATEMENT

86TH LEGISLATIVE REGULAR SESSION

April 30, 2019

TO:
Honorable James White, Chair, House Committee on Corrections

FROM:
John McGeady, Assistant Director     Sarah Keyton, Assistant Director
Legislative Budget Board

IN RE:
SB1154 by Perry (Relating to the powers and duties of the Texas Civil Commitment Office and to certain requirements regarding the payment of costs associated with civil commitment by persons civilly committed as sexually violent predators.), As Engrossed

The provisions of the bill addressed by this analysis would amend various codes as they relate to the civil commitment of sexually violent predators. Under the provisions of the bill, the Texas Civil Commitment Office would be exempted from the requirement to adopt certain administrative rules, the conditions under which an emergency detention order may be issued for a sexually violent predator would be expanded, and sexually violent predators would be required to submit certain financial information upon request.

This analysis assumes the provisions of the bill would not result in a significant impact on the demand for state correctional resources. The bill does not expressly create a felony offense, increase the punishment for an existing misdemeanor to that of a felony, increase the punishment for an existing felony offense or category of felony level offenses, or change the eligibility of a person for felony community supervision, parole, or mandatory supervision.
