The provisions of the bill addressed by this analysis would amend the Election Code as it relates to the offense of unlawful use of public funds for political advertising, which is punishable as a Class A misdemeanor. Under the provisions of the bill, this offense would be expanded to include unlawful use of public funds for certain political activities.
A Class A misdemeanor is punishable by confinement in county jail for a term not to exceed one year and an optional fine not to exceed $4,000. This analysis assumes the provisions of the bill addressing sanctions for a criminal offense would not result in a significant impact on state correctional populations or the demand for state correctional resources.
