A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to the authority of the Public Utility Commission of Texas |
|
|
to set wholesale electricity prices in the ERCOT power region |
|
|
during a state of disaster. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Section 39.160, Utilities Code, as added by S.B. |
|
|
3, Acts of the 87th Legislature, Regular Session, 2021, is amended |
|
|
by adding Subsection (h) to read as follows: |
|
|
(h) Notwithstanding any other provision of this section, |
|
|
during a state of disaster declared by the governor under Chapter |
|
|
418, Government Code, in response to an extreme weather event, the |
|
|
commission may not by order raise the wholesale price of electric |
|
|
energy sold in the ERCOT power region for the purpose of correcting |
|
|
the price of electric energy to match the demand for electric |
|
|
energy. |
|
|
SECTION 2. This Act takes effect on the 91st day after the |
|
|
last day of the legislative session. |
