A BILL TO BE ENTITLED
|
|
|
AN ACT
|
|
|
relating to recall elections for members of the governing body of a |
|
|
home-rule municipality who are elected from single-member |
|
|
districts. |
|
|
BE IT ENACTED BY THE LEGISLATURE OF THE STATE OF TEXAS: |
|
|
SECTION 1. Subchapter C, Chapter 26, Local Government Code, |
|
|
is amended by adding Section 26.048 to read as follows: |
|
|
Sec. 26.048. RECALL ELECTIONS IN SINGLE-MEMBER DISTRICTS. |
|
|
(a) This section applies to a municipality that has a single-member |
|
|
district form of representation for the governing body of the |
|
|
municipality. |
|
|
(b) A municipality may not adopt or enforce an ordinance or |
|
|
charter provision authorizing an election by the municipality at |
|
|
large for the recall of a member of the municipality's governing |
|
|
body who was elected from a single-member district. Only voters of a |
|
|
single-member district may vote in an election to recall a member |
|
|
of the governing body who was elected from the district. |
|
|
SECTION 2. This Act takes effect September 1, 2021. |
