LEGISLATIVE BUDGET BOARD
Austin, Texas

FISCAL NOTE, 87th LEGISLATURE 1st CALLED SESSION 2021

July 9, 2021

TO:
Honorable Lois W. Kolkhorst, Chair, Senate Committee on Health & Human Services

FROM:
Jerry McGinty, Director, Legislative Budget Board

IN RE:
SB2 by Perry (Relating to requiring public school and public institution of higher education students to compete in interscholastic athletic competitions based on biological sex.), As Introduced

No significant fiscal implication to the State is anticipated.

The bill would amend the Education Code relating to requiring public school and public institution of higher education students to compete in interscholastic athletic competitions based on biological sex.

This analysis assumes the provisions of the bill could be implemented using existing resources.

Local Government Impact

The Texas Education Agency assumes there may be administrative costs to districts to gather and maintain evidence of students' sex. Additionally, there may be costs incurred in providing female students the opportunity to compete in an athletic event for which there is not an equivalent female-designated option if the district or school chooses to make this available.
