Amend CSSB 1 (senate committee printing) by adding the following appropriately numbered SECTION to ARTICLE 7 of the bill and renumbering subsequent SECTIONS of that article accordingly:
SECTION 7.___. Subchapter E, Chapter 31, Election Code, is amended by adding Section 31.130 to read as follows:
Sec. 31.130. SUIT AGAINST ELECTION OFFICER. An action, including an action for a writ of mandamus, alleging that an election officer violated a provision of this code while acting in the officer's official capacity may only by brought against the officer in the officer's official capacity.
